Health Canada uses several tools to ensure licensed producers’ (LPs) compliance with the Cannabis Act. These include:
- Compliance Promotion
- Compliance Monitoring
- Enforcement Actions
Dig a Little Deeper
Health Canada developed the licensed producer system to keep Canadians safe. To ensure this safety, Health Canada developed a compliance process to promote, monitor, and enforce actions when necessary.
Compliance Promotion – Health Canada provides LPs with education and information about government policies and guidance. “Health Canada believes that compliance promotion is an effective tool in facilitating compliance with the Act and its Regulations.”
Compliance Monitoring – Health Canada reviews LPs for compliance through a number of ways including site visits, sample testing, and reviewing documents. Monitoring can occur at regular interviews, randomly, or based on a complaint.
Enforcement Actions – Health Canada can enforce compliance in a number of ways. These include:
- Allowing LPs to voluntarily correct any compliance issues
- Issuing warning letters
- Licence suspension
- Product recalls
Health Canada decides what enforcement action is appropriate based on a number of different factors such as:
- Risk to the public
- LP “behaviour” (whether non-compliance was accidental or willful, willingness to cooperate, etc.)
- Compliance history
- Likelihood of reoccurrence
- The need to maintain public confidence in the system
